Artwork & Design Protection Policy
At Evergreen Botanical Studio, every preservation piece is an original work of art, thoughtfully designed and handcrafted in our studio. The composition, arrangement, color treatment, reconstruction, framing, and overall artistic direction are part of the creative work that goes into each piece.
Because of this, our artwork and creative process are protected and are intended to remain exclusive to Evergreen Botanical Studio.
Original Artwork & Designs
All preservation artwork created by Evergreen Botanical Studio is an original artistic work. Our layouts, compositions, design concepts, color treatments, reconstruction techniques, and artistic processes are developed specifically for each individual piece and are not intended to be reproduced, copied, recreated, or used as a template for artwork created elsewhere.
Photographs of completed Evergreen Botanical Studio artwork are also considered representations of our original work.
By commissioning a piece from Evergreen Botanical Studio, you are purchasing the finished artwork, not the underlying design, composition, artistic process, or techniques used to create it.
No Reproduction or Use by Other Artists
Our completed artwork, layouts, photographs, and design concepts may not be:
Recreated or reproduced by another artist or preservation studio
Used as a template, reference, or design blueprint for another artwork
Replicated in whole or in part
Digitally traced, copied, or substantially imitated
Used to create a similar preservation piece for yourself or another person
Submitted to another artist or business with the expectation that they reproduce the work
This applies even when the flowers, materials, or other physical elements originated with the customer.
We understand that customers may love certain elements of their finished piece and may wish to incorporate similar ideas into future artwork. We are always happy to discuss new ideas and create additional work within Evergreen Botanical Studio when appropriate.
Customer-Owned Flowers & Materials
Customers retain ownership of their flowers and any personal materials they provide to us, subject to the terms of their preservation agreement.
However, providing flowers, photographs, invitations, fabric, heirlooms, or other materials to Evergreen Botanical Studio does not transfer ownership of our artistic design, composition, techniques, or creative concepts to the customer.
The physical flowers may be yours, but the original artistic arrangement and finished preservation artwork created from those flowers remain the creative work of Evergreen Botanical Studio.
Photographs & Social Media
Evergreen Botanical Studio may photograph finished preservation pieces for our studio portfolio, website, social media, educational materials, or other promotional purposes, subject to any separate permissions or agreements that apply to customer photographs or identifiable individuals.
Images of our artwork may not be altered, cropped in a misleading manner, reproduced, or presented in a way that suggests the artwork was created by another artist or business.
If you share photographs of your Evergreen Botanical Studio piece, we simply ask that you keep appropriate credit to Evergreen Botanical Studio whenever reasonably possible.
Inspiration vs. Copying
We understand that artists naturally inspire one another, and we are honored when our work inspires creativity.
There is a meaningful difference, however, between inspiration and reproduction.
Our artwork should not be used as a direct blueprint for another preservation piece or intentionally recreated by another artist or business. This includes requesting that another artist reproduce a specific Evergreen Botanical Studio composition, layout, or design based on photographs of our work.
Custom Commissions
Each commissioned piece is created specifically for the customer and their flowers. Because our work is highly individualized, we do not guarantee that a particular composition, layout, or design can or will be recreated for another customer.
Elements of our artistic approach may naturally evolve over time, but individual finished compositions are not available for licensing, resale, or reproduction by outside artists or businesses.
Our Creative Work Matters
We put an extraordinary amount of time, experimentation, skill, and care into developing this art form.
Our goal is not to restrict creativity, but to protect the integrity of the artwork we have spent years developing and to ensure that original work is recognized as original work.
When you commission Evergreen Botanical Studio, you are investing in a one-of-a-kind piece created specifically for you. We are grateful for the trust placed in us and ask that our creative work be treated with the same care and respect that we give to your flowers.
